Terms of Service

Welcome to gkmixing.com (the "Website"). These Terms of Service (the "Terms") govern the relationship between Individual Entrepreneur Gleb Karpovich ("we," "us," "our") and clients ("you," "Client") regarding music mixing and mastering services provided through the Website or direct communication.

By accessing the Website or engaging with our services, you agree to these Terms. Please read them carefully before proceeding.

Our Privacy Policy, which explains how we collect and handle your personal data, is available at https://www.gkmixing.com/cookies-and-privacy.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to engage our services. By submitting an inquiry or making a payment, you confirm that you meet this requirement. If you are booking on behalf of a company, label, or other entity, you confirm that you have the authority to bind that entity to these Terms.

2. Services Provided

We offer professional music mixing and mastering services in stereo and Dolby Atmos formats. These include:

  • Mixing and mastering for stereo and Dolby Atmos (Apple Spatial Audio)
  • Stereo unmastered and mastered mixes, stems, instrumental mixes, and other requested deliverables as per Client needs

All services are provided as "work-for-hire." We claim no ownership rights to the
compositions or sound recordings submitted by the Client.

3. Inquiries and Project Evaluation

Clients can contact us through the contact form on the Website or by emailing contact@gkmixing.com. Upon receiving your inquiry, we will assess the scope of work and provide a non-binding project evaluation, including pricing.

We offer a free, non-committal sample mix of up to 50% of the length of a song. If you are unsatisfied with the sample, there is no obligation to proceed.

4. Pricing and Payment Terms

4.1 — Pricing

Pricing is based on project scope and agreed upon with the Client. Flat rates are offered according to project requirements and Client budget. All prices are quoted and invoiced in USD.

4.2 — Payment Methods

We accept payment through direct bank transfer, PayPal, or Western Union as our standard payment methods. Upon Client request, we may consider alternative payment methods if technically feasible for international transfers from our location in Georgia. Please note that certain payment platforms may not be available due to regional restrictions. Payment method options will be confirmed during initial project discussions.

4.3 — Payment Options

  • Full Payment Upfront: The Client may pay the entire agreed amount before work begins.
  • 50% Non-Refundable Deposit: The Client may pay a 50% non-refundable deposit upfront, with the remaining 50% due upon project completion. Final files will not be released until the remaining balance is received.

5. Revisions

We offer unlimited revisions until the Client is satisfied with the mix.

Once the final mix is approved by the Client, any subsequent revision requests will incur a fee of $50 per request.

We reserve the right to decline further service if we are unable to achieve a satisfactory result after reasonable efforts. In such cases:

  • If the Client paid in full, they are eligible for a 50% refund.
  • If the Client paid a 50% deposit, we retain the deposit and the Client is not
    required to pay the remaining balance.

In either case, the Client will receive all completed project files to transfer to another engineer.

6. Cancellation Policy

6.1 — Before Work Begins

If the Client cancels before any work has started, a full refund will be issued, except for any non-refundable deposit already paid.

6.2 — After Work Has Begun

If the project is cancelled after work has started:

  • If a 50% deposit was paid, the deposit is non-refundable.
  • If full payment was made, we will refund 50% of the total project cost.

6.3 — Goodwill Exceptions

In rare circumstances — such as a documented personal emergency or a situation we consider genuinely exceptional — we may, entirely at our own discretion, offer a partial refund or project credit as a goodwill gesture. This does not set a precedent and does not alter the standard cancellation policy above.

7. Turnaround Time

  • Samples: Free sample mixes are delivered within 5–10 business days.
  • Paid Projects: The initial mix will be delivered within 5 business days from project commencement. Each revision request may extend the timeline; we commit to completing each revision within 2 business days where possible. We will promptly notify the Client of any anticipated delays.
  • Expedited Services: Available upon request with a 10% surcharge applied to the total project price.

Turnaround times are provided in good faith and are not guaranteed. Delays caused by late submission of materials, unclear feedback, or circumstances beyond our control do not constitute a breach of these Terms.

8. Client Responsibilities

To ensure timely and efficient delivery, Clients must:

  • Provide high-quality WAV files (minimum 44.1 kHz, 24-bit) for all submitted material.
  • Ensure files are clearly named, with all tracks starting from the same position (bar zero or bar one).
  • Designate a single point of contact for revision requests and communications if multiple parties are involved.
  • Respond to communications in a timely manner. We are not liable for delays caused by a lack of Client response.

9. File Specifications and Deliverables

All files provided by the Client and delivered by us must meet the following specifications:

  • Format: WAV
  • Minimum quality: 44.1 kHz, 24-bit

Upon project completion, Clients will receive:

  • Stereo unmastered mix
  • Stereo mastered mix
  • Dolby Atmos mix (Apple Spatial Audio), where applicable
  • Stems, instrumental mixes, or other agreed deliverables

10. Intellectual Property and Rights

10.1 — Ownership

The Client retains full ownership of the final product. We do not retain any rights to the mixes or masters, except for portfolio usage as described in §10.3.

10.2 — Client Warranty

By submitting materials, the Client warrants that they hold all necessary rights to the material provided — including compositions, recordings, samples, and any other copyrighted content — and are solely responsible for obtaining all required licences, permissions, and clearances.

10.3 — Portfolio Usage

We reserve the right to use clips of up to 30 seconds of completed work for portfolio purposes on our website and social media accounts (including Instagram, YouTube, and SoundCloud).

If you need to keep a project confidential prior to release, notify us in writing at the time of booking. We will withhold all portfolio usage until your confirmed public release date, or for a maximum of 12 months, whichever comes first.

10.4 — Credits

The Client agrees to provide credit in all physical and digital releases in the following format:

"Mixed and/or Mastered by Gleb Karpovich" or "Mix/Master Engineer: Gleb Karpovich"

Where possible in digital distribution, a hyperlink to gkmixing.com should be included.

Failure to provide agreed credit does not entitle the Client to a refund. We reserve the right to withhold future services until credit is correctly attributed.

11. Indemnification

11.1 — Client Indemnification

The Client agrees to indemnify, defend, and hold harmless Individual Entrepreneur Gleb Karpovich from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys' fees — arising out of or connected with the Client's materials, including any claim of intellectual property infringement.

11.2 — Service Provider Indemnification

We agree to indemnify, defend, and hold harmless the Client from and against any claims, liabilities, damages, losses, and expenses arising directly from our services or an alleged breach of these Terms on our part.

12. Confidentiality

We will maintain the confidentiality of all Client materials and communications. We will not share, distribute, or otherwise make available any unreleased Client materials to third parties without explicit written permission, except as required by law. This confidentiality obligation survives the termination of our services.

13. Dispute Resolution

We are committed to resolving any issues through direct communication. In the event of a dispute, please contact us at contact@gkmixing.com. We will respond within 5 business days.

If a dispute cannot be resolved through communication within 30 days, all legal matters shall be governed by the laws of Georgia, and any legal proceedings shall take place in Georgia.

14. File Delivery

Final deliverables are provided via Dropbox or other secure file-sharing platforms including Proton Drive, iCloud, or Google Drive. If issues arise with any platform, we will use an alternative method. We are not liable for problems caused by third-party services.

14.1 — Limitation of Liability

Our total liability for any claims under these Terms shall not exceed the amount paid by the Client for the services in question. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising out of or relating to these Terms or services provided.

15. Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, civil unrest, embargoes, or strikes. The affected party shall notify the other as soon as reasonably possible.

16. Termination for Non-Response

If the Client fails to respond to our communications for more than 14 days without prior notice, the project may be considered abandoned and terminated. In such cases, any deposit paid is non-refundable, and outstanding balances remain due according to §4.3.

If exceptional circumstances prevented your response, please contact us as soon as possible. We will review the situation and may, at our sole discretion, resume the project without penalty.

No work will commence until full payment or the agreed deposit is received. Missed payments may result in delays or project termination.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified or removed to the minimum extent necessary, without affecting the validity of the remaining provisions.

18. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on the Website with an updated "Last Updated" date.

For changes that materially affect Client rights, we will provide at least 30 days' notice via a notice on the Website and/or by email to active Clients before the new Terms take effect. For existing projects mid-delivery, the Terms in effect at the time of booking will continue to apply until that project concludes.
